Document Updates

  • The MT Acknowledgement that Real Property is Not Exempt (Cx1412) has been reinstated for Montana closings to meet FNMA requirements, despite the original state law being repealed. It confirms the borrower’s waiver of homestead rights and includes updates to notary language and signature formatting to align with current standards. Read more.

  • The Oklahoma version of the Section 184 Fee Simple Land Rider (Cx7921) was updated to meet state recording requirements, specifically increasing the top margin to 2 inches on page 2 and any subsequent pages when the property is in Oklahoma. Page 1 remains unchanged, ensuring compliance with statutory formatting rules while maintaining existing document structure. Read more.

  • Updates were made to the first paragraph of the Texas Assignments (Cx1549, Cx4349, and Cx4487) to improve consistency with other state assignment documents in the Docutech library. Key changes include revised legal language, replacing borrower formatting with “Borrower Vesting,” adding clarifying trustee language, and relocating the loan amount with expanded promissory note wording.   • A new “Notary Public Printed Name” label and line has been added beneath the notary signature block to ensure the notary’s name is clearly provided, even when the corresponding data field isn’t populated. This helps prevent blank notary name fields and improves compliance with Kansas recording requirements across multiple documents. Read more.

  • The New Jersey HELOC Mortgage (Cx1359) was updated to better align its “Mortgaged Premises” language with the FNMA/FHLMC Uniform Instrument template, improving consistency with other New Jersey security instruments. It also adds fields for “Recording Jurisdiction Type” and “Property County” above the property description and address, along with minor formatting updates to the first page. Read more.

  • To comply with North Carolina law, updates were made to ensure the mortgage broker’s name is printed on the first page of applicable security instruments when the loan is broker-originated. The broker name will appear above the recording data section and only populate when the corresponding field indicates a brokered loan, along with minor formatting updates for consistency across documents.   • An update to the Illinois Disclosure of Financial Interest (Cx28407) introduces a new field to designate the eSign role for the “Signature of Producer,” ensuring clearer identification of the signer during electronic execution. The role defaults to “Loan Officer” if not specified, continues to use the existing field for the signer’s name, and does not apply when the document is ink-signed. Read more. 

  • To address new California recording requirements, Docutech updated its generic California security instruments by replacing the existing PIN tag with a combined “AIN/APN/PIN” tag on the first page. This change helps ensure compliance with legislation allowing counties to require assessor identification numbers and reduces the risk of recorder rejections, especially as some counties already enforce these requirements.   • The Affixation Affidavit (Cx43) will no longer be treated as an “Other Rider” to the Security Instrument and will instead print as a standalone recordable document. This change aligns with common county recording practices and helps prevent rejection issues in jurisdictions that require the affidavit to be recorded separately. Read more.

  • For RD/USDA construction-to-permanent loans, this update allows lenders to control which first payment date prints on the 3200 Fixed Rate Note (Cx25454). A new field enables the construction-phase first payment date to print when selected; otherwise, the standard permanent loan first payment date continues to display, aligning with USDA guidance that gives lenders flexibility on timing.   • Oregon prepayment disclosure documents were enhanced to allow more flexible language based on how the prepayment penalty is calculated. The system now dynamically generates the wording using a selectable field (e.g., amount prepaid, unpaid principal balance, or original principal), defaulting to original principal if no option is chosen, improving alignment with loan configurations and business needs.  Global Required Field Prompt Updates

  • The “Exclude Interest for Term of Loan” (FI 51916) field has been updated and is used to identify construction loan programs with a 0% interest rate, prompting a change to the global required field behavior for the Construction Loan Interest Rate (FI 539). As a result, the system ensures the interest rate field is handled appropriately when this zero-interest indicator is selected, improving accuracy and compliance in loan documentation.
